Wherever in these Terms the masculine is used, it also refers to the feminine. Wherever a provision is worded in the singular, the reference is both to the singular or plural as the case may be.<\/li><li>The website is owned by Alma and is exclusively managed and operated by it. The use of the website is offered to you subject to your acceptance of the provisions, conditions and notices contained in these Terms. Therefore, the use of the website, in any way, whether through a personal computer, mobile phone or any other electronic means, will be considered as your consent to all the terms, notices and conditions appearing in these Terms. You may use this website only if you have agreed to all the provisions, conditions and notices that appear on it with the clear understanding that they will bind you in all respects. You are requested to read these Terms carefully before using the site. If you do not agree and\/or wish to be bound by these Terms, you are requested to leave the site. The use of this website is permitted only for adults over the age of 18 and\/or entities capable of creating legal obligations, therefore the use of the website by minors is strictly prohibited.<\/li><li>This website presents information about Alba&#8217;s products and enables the purchase of the products (the &#8220;<strong>service<\/strong>&#8220;).<\/li><li>The provisions of these Terms apply to any use and purchase made by the customer (hereinafter &#8220;<strong>customer<\/strong>&#8220;) on the site and will form the legal basis for any discussion between the customer and Alma.<\/li><li>Browsing the website and\/or purchasing a product offered for sale on the website constitutes the customer&#8217;s agreement to accept and act according to the Terms, therefore if the customer does not agree to any of the provisions of the Terms, he is asked to refrain from any use of the website.<\/li><li>At Alma, we believe in the quality of our products and service and are committed to the highest standards.<\/li><\/ol><p>\u00a0<\/p><p><strong><u>Purchase via the website<\/u><\/strong><\/p><p><strong><u>\u00a0<\/u><\/strong><\/p><ol><li>Any person who is over the age of 18 and has a valid credit card may perform an action on the website.<\/li><li>Purchasing via the website is limited to personal and non-commercial purposes. Alma is entitled not to honor and\/or to cancel orders and\/or purchases that it believes were made for commercial purposes and\/or sales to third parties.<\/li><li>An order on the website will be accepted and sent to the purchaser if all the following conditions have been met:<\/li><\/ol><ul><li>The items ordered are available and listed as existing in stock at the time of placing the order.<\/li><li>The details of the order have been filled in completely and correctly for the purpose of billing and shipping the jewelry to the customer.<\/li><li>Approval of the transaction has been given by the credit company and\/or bank approval was received for the bank transfer.<\/li><li>Review of the order has been confirmed by Alma<\/li><li>Orders received on this website will be processed and confirmed by Alma on the same day or the next business day at the latest<\/li><\/ul><p>\u00a0<\/p><ol start=\"4\"><li>When choosing the free shipping option, Alma will send the shipment to you between 10 &#8211; 20 working days,.<\/li><li>When making a purchase on the website, the customer will be required to enter the following details into the electronic form: first name, last name, telephone number, city, zip code, e-mail, product delivery address and payment details. By entering these details on the electronic form, the customer confirms that the details are correct. It is hereby stressed that submitting false personal details is a criminal offense and it is the customer&#8217;s responsibility to provide their full and accurate details when placing the order for any purchase.<\/li><li>After confirmation of the order by the customer, using the &#8220;send&#8221; option, the order will be transferred to Alma for execution. From the moment the order is confirmed, as mentioned, the order cannot be changed and\/or canceled by the customer. The order will be confirmed by sending an e-mail message that will reach your address within 24 hours from the order confirmation date. If the ordered jewelry is not in stock, or the credit card company did not approve the charge, Alma will not be obliged to provide the customer with the jewelry that he ordered. A notification will be sent to the customer and the customer&#8217;s credit card will not be charged.<\/li><li>Alma takes the most advanced precautions to ensure a secure purchase. The Alma website is secured via SSL and the transfer of credit card data on the website is carried out through a purchase via a secure portal. Alma does its best to protect the integrity of the information received on this site and to keep it confidential. The information is collected and saved in the secure environment of Hypertext Transfer Protocol Secure for the purpose of identifying the customer when making the purchase or during a visit to the website. The customer&#8217;s credit card number is used exclusively to make a purchase in a secure environment with an encrypted SSL standard. Alma does not have access to the credit details entered at the time of purchase nor to the identity card number of the cardholder and does not save the above data.<\/li><li>With each shipment of jewelry, the customer will receive a packaging box, an international gemological certificate that includes all the details of the jewelry and an estimate of the price of the jewelry and a receipt.<\/li><li>Alma is not responsible for delays in the delivery of the product due to reasons beyond its control, including strikes, embargoes and other technical malfunctions, as well as if the customer is not available to receive the shipment.<\/li><li>The photos on this website are largely generic since Alma&#8217;s stock of diamond jewelry is renewed from time to time, therefore there may be a divergence between the photo on the website and the received item, especially with regard to the size and quality of the diamond(s). Also, the photos on the website may have undergone Photoshop processing such as conversion from white gold to yellow gold etc. The photographs of the jewelry that appear on the website are for illustration purposes only. Alma makes every effort to ensure that the colors and\/or designs and\/or shades appearing in the photograph of the jewelry are faithful to those present in the jewelry that will be delivered. However, there may be differences and\/or inaccuracies originating from graphics constraints, techniques, use of different resolutions, use of different software, etc.<\/li><li>Website prices are usually fixed; however Alma reserves the right to amend prices according to market fluctuations, changes to foreign exchange rates, input costs, etc. from time to time.<\/li><li>If, after placing an order, it turns out that the product is out of stock, due to unusual circumstances that were not known at the time of the order, Alma will inform the customer of this within one business day and allow him to choose between receiving a replacement and equivalent product or a full refund of the money paid.<\/li><li>If, in good faith, an unusual and obvious mistake was made in the description of the product and\/or its price, this will not bind Alma. If the customer contravenes the foregoing or Alma has reasonable grounds to suspect that the customer has contravened the foregoing, Alma has the right to indefinitely deny or terminate customer\u2019s access to the website and to refuse to honor customer\u2019s order(s).<\/li><li>Alma reserves the right to cancel or change an order, provided that it notifies the customer before the delivery date of the order. In case of cancellation, the customer will not be charged for paying the total order, and in the case of a change, the customer will be charged according to the changed order.<\/li><li>Visitors to the website are prohibited from copying, distributing, transmitting, displaying, duplicating, publishing, creating derivative works or selling any of the information, software, jewelry, designs, intellectual property or connections originating from this website.<\/li><li>Availability of the jewelry &#8211; Alma makes every effort to ensure that the jewelry offered for sale on the website is in stock at the time of placing the order, unless stated otherwise. Alma reserves the right to stop at any time and without prior notice, the production of any jewelry and\/or its offer for sale and the website visitor hereby waives any claim and\/or demand in connection therewith.<\/li><li>The Customer agrees and acknowledges that on the Website all Product(s) are offered only at Alma&#8217;s sole discretion for a restricted time and only for the available supply, whilst stock lasts. Prices on the website are subjected to change without any prior notice, as the prices are calculated according to current prices of precious metals and gems.<\/li><li>Alma reserves the right to put a limit on the number of items purchased or orders placed via the website. Alma, however, is not responsible for any damage and\/or loss of the jewelry after receipt of the jewelry by the customer.<\/p><p>When purchasing rings, we undertake to provide customers with a first measurement amendment service at no additional charge.<\/p><p>\u00a0<\/p><p><strong><u>Returns and cancellation of a transaction<\/u><\/strong><\/p><p>\u00a0<\/p><p>Where a jewelry transaction is made following Alma&#8217;s contact to the customer through online advertising via the website, via the telephone and\/or by any other means of communication, without the customer being given the opportunity to get an impression of the product directly (where a transaction is not made by physically visiting the business).<\/p><p>\u00a0<\/p><p>A notice of cancellation of a transaction will be given to Alma by telephone: 1888-965-2210 &#8211; or by email: <a href=\"mailto:info@alma-diamonds.com\">info@alma-diamonds.com<\/a> \u00a0or by registered mail to: 3 Jabotinsky Street Ramat Gan 5252005 ISRAEL. In the cancellation notice, the informant shall specify the name and identity number of the customer as well as the order number.<\/p><p>The results of the cancellation of the transaction are regulated under Section 14E of the Israel Consumer Protection Law and by virtue of it there is an obligation to return the consumer&#8217;s money within 14 days of receiving the cancellation notice.<\/p><p>As far as possible, the product should be returned by the customer in its original packaging. Alma is entitled to claim damages due to the fact that the value of the item has decreased as a result of a significant deterioration in its condition.<\/p><p>The right of cancellation is not valid regarding jewelry that was made especially for the customer.<\/p><p>Jewelry that will be created with a personal design or a change to the jewelry that is in stock for the customer, such as laser engraving at the customer&#8217;s request, will not be given monetary credit.<\/p><p>Regarding cancellation fees and the return of the jewelry, Alma makes a distinction between cases where a transaction is cancelled due to a defect, discrepancy or failure to deliver on time and where a transaction is cancelled for another reason.<\/p><p>If the customer cancelled the transaction due to a defect, discrepancy, failure to deliver on time or another contractual violation, even if the packaging of the product has already been opened, Alma will return the customer&#8217;s money within 14 days of receiving the defective product.<\/p><p>In the event that the cancellation is made by the customer for any other reason, the customer must return the jewelry to Alma at his own expense, and Alma may demand a cancellation fee of 15% of the amount of the transaction.<\/p><p>\u00a0<\/p><p><strong><u>Intellectual Property<\/u><\/strong><\/p><p>\u00a0\u00a0<\/p><p>All copyright and intellectual property related to the website, including the content of the website, its name, design, trademarks and service marks appearing on it, jewelry designs and all copyrights, designs and patents appearing on it belong to Alma, only. Do not copy, distribute, display or make use of them and\/or transfer to a third party any part of the intellectual property without obtaining Alma&#8217;s express written consent.<\/p><p>\u00a0<\/p><p><strong><u>The use of &#8220;cookies&#8221; on the website<\/u><\/strong><\/p><p>Alma sends &#8220;cookies&#8221; on its behalf to the customer&#8217;s computer in order to collect statistical data about the use of the site and to adapt the site to the customer&#8217;s personal preferences. &#8220;Cookies&#8221; are text files, which the browser creates according to the command of the site&#8217;s computers and saves on the hard drive of the customer&#8217;s computer.<\/p><p>\u00a0<\/p><p>These files contain information such as the pages the customer has visited, the length of time the customer stayed on the site, where the customer came to the site from, and information the customer asked to see while on the site. Please include your order number in the email. After receiving a Return Authorization, you will be required to fill out a return form that must accompany your return. Alma will not accept returns without a Return Authorization together with a return form.<\/p><p>\u00a0<\/p><ol start=\"2\"><li>For all returns and exchanges customers must include all original documents and diamond certificates. Missing diamond certificates will incur a $250 fee. Do not send your item(s) back in the original packaging. You must double box your package &#8211; put your item(s) in its original ring or jewelry box and place it in a small box or envelope and then place the small box or envelope inside another box. We also recommend taping the small box or envelope to the inside of the larger box. You are responsible for making sure your items are securely packaged. Please also make sure to include your return form.<\/li><li>Print and affix your label<\/li><\/ol><p>For security reasons, please do not write &#8220;Alma Diamonds&#8221; on the label. We suggest simply writing &#8220;Alma&#8221;, on the label.<\/p><ol start=\"4\"><li>Insure your return shipment<\/li><\/ol><p>Alma is not responsible for any lost, stolen or damaged shipments that are sent by you during the return process. You are responsible for properly returning your items to Alma. If you are returning your package using the carrier of your choice, you are required to insure your shipment and you must require adult signature upon delivery.<\/p><ol start=\"5\"><li>Please allow up to 15 business days for Alma to process your return.<\/li><\/ol><p>Alma will send you an email confirmation when we receive the package.
